The Bill of Rights keeps slip sliding away. The right-wing activists on the Supreme Court say they are against government power. In fact their rule is very different. Big Corporations win. Individuals lose. That is their consistent rule, their only consistent rule. They are all for government power so long is large corporations can do anything they want. If you want to see legislating from the bench -- see the decisions of the right-wing on the Supreme Court. Bush v. Gore of course was the most flagrant example of a ruling with no rational reasoning (reached only because Sandra Day OConnor et al could impose their candidate over the candidate chosen by the majority of voters in the U.S. and the majority of voters in Florida) -- but there are scores of such examples where the simple rule is: Stay out of the way of big corporations and government can do anything it wants. End of legal reasoning.
