The Brady Rule is a fundamental tenet of American criminal law. A prosecutor, whose duty is to seek justice, has the absolute obligation to disclose any evidence that may exculpate a Defendant. Violation of that duty is a violation of the Constitutional rights of the Defendant and while it risks that an innocent person may be convicted, it also risks that the true guilty defendant may be allowed to remain free.
