The Case Of The Muslim Veiled Woman Removing The Veil To Give Trial Evidence Abu Eesa Niamatullah, 1st Ethical CT/ September 16, 2013 Concerning the case of the Muslim veiled woman in court having to remove her niqab during the giving of evidence: judiciary.gov.uk/Resources/JCO/Documents/Judgments/The%20Queen%20-v-%20D%20%28R%29.pdf I have read in detail the Judge’s discussion of the matter and his judgement (attached) and I conclude that despite my position of the niqab being a recommended and rewarded act for our female Muslims to aspire to more than ever before, the Judge, HH Peter Murphy has ruled with balance, sensitivity and sound basis in law. It is a reasonable and intelligent conclusion which I agree with, which basically states: - the woman can wear her niqab in court, - she can be identified by a female as of when necessary, - she must remove her niqab whilst giving evidence so that only the Judge, the lawyers and Jury can see her - all others will be screened from her at this time - court recorders are forbidden from pictorially representing our sister - if giving evidence will adversely affect the witness (the Muslim woman in question) and perhaps make her appear guilty due to the difficulty of addressing non-related men, she can give evidence via video-link And all of this is based on protecting justice, and thus the rights of the complainant and the defendant (the Muslim woman in question) at all times. I appreciate the sensible and fair approach of Judge Peter Murphy and commend him for a difficult decision. Not only that, I find nothing in Islamic law which would prohibit such a ruling as well.
