The Chief Secretary The Commissioner, Civil Supplies The Additional Secretary, CS The District Collector, Kottayam The District Supply Officer, Kottayam The Taluk Supply Officer, Vaikom Sir, Refer to the notice issued to me as part of complaint to DSO Kottayam demanding investigation on substandard & substituted commodity viz. CMR supplied by AWD/Miller through ARD 60 under Taluk Supply Officer, Vaikom in November 2014. Though the issue warrants urgent attention of the authorities as provisioned in Essential Commodities Act 1955, PDS Control Order 2001 & Kerala Rationing Order1966, the concerned authorities are investigating this case in a snail walk pace to favour the miscreants and destroy all evidences. The matter was also reported to the District Magistrate for contraventions of the PDS Control Order 2001. The concerned DSO & TSO are intentionally delaying the investigation from extraneous and fraudulent influence coupled with their loss of ongoing pecuniary benefits. It is pertinent to mention here that since registration of the complaint, the DSO, TSO and their staff maintained whimsical attitude to me. They were much disturbed and bothered about the blacklisting of mills and other ill-consequences to the AWD agents rather than the present fate of consumers forced to accept substandard commodities. The Ration Inspector was informed well in advance regarding the convenience of hearing me at home with available timings. Still the officer visited my house in my absence and assured other members that he would be coming again to hear my side, but he never came. Meanwhile, the DSO & TSO resorted to all unfair means forcing me to withdraw the complaint with the help of their nexus with ARD, AWD agents and Mill Owners. I received several life threats referring all my queries at DSO’s office and TSO’s office. Those threatened me were well informed of my submissions to the DSO and TSO with regard to RTI queries on ARD level Vigilance Committees and low attendance of staff at the former’s office while making the complaint, invariably underscoring the collusion between officials and their beneficent quarters. The purported ration looters forewarned me of ill-consequences by causing fatal damages to self, family members and property for resorting to repeated complaints against them. I am in the process of filing a CMD in a Civil Court. I kept these matters posted to the Commissioner of Civil Supplies, Mr. Shyam Jagannathan, IAS in the order of its incidence both by formal and informal modes of communications. The attention of all concerned authorities is brought to the seriousness of the affairs in the department. I fear the present notice is sent to call me at their office, further pressurise and threaten me in front of all their interested agents compelling me to withdraw the complaint. I further fear, the staff exercising possible constraints in my freedom of expression in this regard in a pre-configured atmosphere under the roofs of Taluk Supply Office. The law provides paramount importance to redressal of complaints in a time bound manner adequately providing all infrastructures to the department including a squad with vehicle facilities. It is now your obligation, rather than my requirement to hear me at my convenience in a free atmosphere at home. Many staff within the department assured me in the light of impunities and fate of earlier complaints that my complaint will not be going beyond an ARD or an AWD. It is my humble request to the Commissioner of Civil Supplies, being the officer entrusted with all statutory functions as mentioned in para 2 that the scope of investigation should invariably transit from AWD to the officers who conducted joint sampling of the commodity(CMR) and to the Miller. It will be futile and wastage of public money if a Taluk Supply Officer is investigating the matter with many things outside his jurisdiction. As such, I have no faith in a TSO or DSO who turned inimical to me in collusion with an AWD agent just because of my submissions regarding setting up of permanent ARD level Vigilance Committees. The integrity of these officers are in question. Under these circumstances, I appeal the Commissioner of Civil Supplies to unravel the mystery surrounding the commodity substitution from ‘Fair average Quality’ during sampling at the Mill to ‘Inferior quality’ at the delivery point. IMMEDIATE ACTIONS TO BE TAKEN FROM YOUR SIDE HENCEFORTH TO DISPLAY THE SAME COMMODITY CERTIFIED BY THE JOINT SAMPLING TEAM AT THE MILL IN THE ARDs FOR THE PUBLIC TO CROSS CHECK ANY MISMATCH. Any difficulty in following this procedure (which is supposed to be in practice) be urgently addressed at concerned level for speedy implementation. Till the time your staff is giving all support and slip slop attitude in handling complaints, diversions, Pilferage and Substitutions cannot be stopped, but an informed customer like me can do many things to streamline things as per our requirements. The laws are framed to achieve this objective. My outcry for an ARD level Vigilance Committee is not a Utopian one, but is the same provisioned by PDS Control Order 2001. I am waiting for your official notification in this regard. Though you have announced a similar mechanism recently in Supplyco, your execution arm, it didn’t materialise. But I assure you, it may not be the fate of ARD level Vigilance Committees. I have witnessed enough contraventions, commissions and omissions at various levels contrary to established procedures. I am compelled day by day to approach the Hon. High Court of Kerala with a writ in this regard. I hope the positive actions which you are going to take in coming days will satisfy me to that extent. The gross negligence of your officers in dealing a public interest petition will be summarised in due course and the same will be brought to the papers of Lokayukta, Kerala for lack of accountability and punitive actions.
