The City of Tea Tree Gully - Naturally better at providing misinformation and half-truths. Ive re-posted this as I realised when re-reading stuff, I got it wrong in regards to greyhounds (I shouldnt do this sort of stuff with screaming kids around!!!!). I have fixed my error. I guess as I am simply an uneducated pleb in the community, I am allowed an error once in a while (unlike an authority charged with policing the laws it is giving information about. I stand by the rest of my comments though!!! With the exception of possibly a few comments later this evening, I am taking a break of a few weeks minimum from posting on this page. Here is yet another example of typical CTTG’s blasé attitude and incompetence when it comes to informing the community about laws it is responsible for policing. So bad has the CTTG’s provision of information about the law been, it has created a defence for almost any allegation that it makes against anyone. The defence is that the CTTG doesn’t appear to understand the laws it is policing and that it is common practice for the CTTG to provide information about the law to the community that is blatantly wrong. teatreegully.sa.gov.au/page.aspx?u=1589 On the CTTG’s website at the page headed ‘Dog Expiations’, the CTTG sets out: “Expiation Notices can be issued for a number of offences under the Dog and Cat Management Act 1995 such as: Keeping an unregistered dog Failing to notify Council if your dog is deceased, if the dog has been missing for more than 72 hours or if the ownership of the dog has changed Failing to correctly identify your dog Keeping more than two dogs on a property without approval Allowing a dog to wander If your dog attacks, harasses or chases a person, animal or bird Transporting an unrestrained dog in a vehicle If your dog causes an injury to a person lawfully entering your property If you allow a dog to be in the grounds of a school, kindergarten, child care centre or pre-school without the permission of the person in charge If you take your dog into a shop without the permission of the shopkeeper If your dog rushes or chases a vehicle If your dog creates a noise by barking to an extent that it unreasonably interferes with the peace, comfort or convenience of another person If your dog defecates in a public place and you do not immediately remove the faeces and dispose of them in a suitable manner If you are the owner of a greyhound and the dog does not have a muzzle securely fixed on its mouth” I have repeated the statements made on the website and added some comment in CAPS. “Expiation Notices can be issued for a number of offences under the Dog and Cat Management Act 1995 such as: Keeping an unregistered dog FAIR ENOUGH (BUT THERE ARE THOUSANDS OF UNREGISTERED DOGS OUT IN THE CTTG COMMUNITY AT THIS VERY MOMENT BECAUSE OF THE WAY THE CTTG OPERATES ITS DOG REGISTRATION SYSTEM). Failing to notify Council if your dog is deceased, if the dog has been missing for more than 72 hours or if the ownership of the dog has changed FAIR ENOUGH BUT THE CTTG COULD HAVE MENTIONED THE EXTRA SITUATION WHERE A PERSON IS REQUIRED TO NOTIFY THE COUNCIL BEING WHEN THE DOG IS REMOVED FROM THE PLACE RECORDED ON THE REGISTER THAT IT IS USUALLY KEPT WITH THE INTENTION IT WILL BE KEPT SOMEWHERE ELSE. Failing to correctly identify your dog WHAT THE?? THIS IS AMBIGUOUS. SOMEONE READING THIS COULD THINK “IS IT AN OFFENCE IF I AM AT THE PARK, THERE ARE A NUMBER OF SIMILAR LOOKING DOGS AND I ACCIDENTLY IDENTIFY AND CALL THE WRONG DOG?”. THIS STATEMENT IS OBVIOUSLY IN REGARDS TO THE PROVISION IN THE DOG AND CAT MANAGEMENT ACT TO DO WITH THE SITUATIONS THAT DOGS ARE REQUIRED TO WEAR THEIR REGISTRATION DISKS. C’MON CTTG, IF YOU ARE GOING TO SAY ANYTHING AT ALL, AT LEAST GET IT RIGHT!!!! Keeping more than two dogs on a property without approval WRONG!!!!! THIS STATEMENT HIGHLIGHTS EXACTLY WHERE THE CTTG IS AT IN REGARDS TO ITS ADMISITRATION OF LAW. FIRSTLY, IT IS NOT AN OFFENCE AGAINST THE DOG AND CAT MANAGEMENT ACT TO KEEP MORE THAN TWO DOGS ON A PROPERTY WITHOUT APPROVAL AS STATED BY THE CTTG. SECONDLY, THE NUMBER OF DOGS THAT MAY BE KEPT IN PROPERTIES IN THE TEA TREE GULLY COUNCIL AREA IS GOVERNED BY CTTG BY-LAW NO. 4. WHICH SETS OUT THAT A PERSON MUST NOT KEEP, WITHOUT THE COUNCIL’S PERMISSION, MORE THAN ONE DOG IN A SMALL DWELLING OR MORE THAN TWO DOGS IN PREMISES OTHER THAN A SMALL DWELLING . FOR THE CTTG TO MAKE SUCH A BLATANTLY WRONG STATEMENT REEKS OF GROSS INCOMPETENCE. Allowing a dog to wander FAIR ENOUGH If your dog attacks, harasses or chases a person, animal or bird FAIR ENOUGH Transporting an unrestrained dog in a vehicle WRONG!!!!! UNDER THE DOG AND CAT MANAGEMENT ACT IT IS NOT AN OFFENCE TO TRANSPORT AN UNRESTRAINED DOG IN A VEHICLE. IT IS AN OFFENCE TO TRANSPORT AN UNRESTRAINED DOG IN THE OPEN TRAY OF A UTILITY, TRUCK OR OTHER SIMILAR VEHICLE (THERE ARE A COUPLE OF EXEMPTIONS TO THIS REQUIREMENT). If your dog causes an injury to a person lawfully entering your property FAIR ENOUGH If you allow a dog to be in the grounds of a school, kindergarten, child care centre or pre-school without the permission of the person in charge MOSTLY RIGHT BUT THE CTTG FAILED TO MENTION THAT THIS DOES NOT APPLY TO ACCREDITED GUIDE, HEARING OR DISABILITY DOGS. If you are the owner of a greyhound and the dog does not have a muzzle securely fixed on its mouth” SORT OF RIGHT BUT FAILS TO MENTION THE OTHER REQUIREMENTS AND EXEMPTIONS TO THIS. As you can see, the CTTG is the provider of misinformation and half-truths. How can the community have any confidence whatsoever that the laws that the CTTG is tasked with policing are being policed correctly? How can anyone in the CTTG area be expected to comply with the laws administered by the CTTG when the information put out to the community by the CTTG is wrong? This is only just one example of where the CTTG has got it wrong. There are others. To top it off, the CTTG appears to operate a dog registration system that is outside the law e.g. operating a registration system that effectively allows peoples’ dogs’ registrations to expire and the dogs be unregistered for a period before they have to be renewed. C’mon Councillors who read this site. Please wake up to what is going on with the CTTG in regards to its administration of the law and do something about it. What has been occurring over the last four years (probably longer) is absolutely scandalous. The CTTG makes the Keystone Cops look like the Professionals. As a CTTG ratepayer who believes in the proper administration of the law and the proper administration of justice, I am appalled and embarrassed by the activities of the CTTG and its version of law enforcement and justice. PS: - My Dog Miriam is still unregistered and therefore I am currently breaching S33 (2) of the Dog and Cat Management Act (Miriam’s registration expired on 30/6/14). In 6 days’ I will be breaching of section 33 (3) of the Dog and Cat Management Act which sets out “If a person is guilty of an offence by reason of a dog being unregistered, the person is guilty of a further offence for each 14 days that the offence continues.” PPS: - I was considering writing to the CTTG to request that Miriam’s name be changed on the Council’s Dog Register to ‘Pat’. Then I realised that I would constantly hear “Oh I get it, Pat the dog!!!”. I could only take that for so long!!
