The Delhi High Court has directed the Central Board of Secondary Education (CBSE) to consult its regional office and file a status report on the extent of the recent Class XII physics examination paper leak. A PIL had been filed before the court seeking a re-examination of the subject across the country and not just in Manipur where the question paper was leaked. The court of Acting Chief Justice Badar Durrez Ahmed and Justice Siddharth Mridul also observed that the CBSE should have “anticipated that once leaked on websites, the question paper would have spread like a wildfire”. “You should have inquired all angles pertaining to the leak… You should have anticipated that a leaked question paper through websites spreads like wildfire. Find out from your (CBSE) regional office as to how the question paper got leaked,” the court said. In the plea field before the court, advocate Rajeev Ranjan Dwivedi has argued that the CBSE’s decision to conduct a re-examination only in Manipur was “in violation of the Constitution” since it discriminated against the students from other parts of the country and against poor students who did not have access to the leaked paper online. “Have you (CBSE) conducted an inquiry as to how many hits the websites received after leaked question paper was posted on them?” the court said. Noting that the question paper would not have remained restricted in the “geographical boundary”, the plea stated that “all influential persons” with “access to mobile and internet” would have seen the leaked paper and, therefore, might have scored better than other candidates who had not been able to purchase the leaked paper. “If the leaked question paper is downloaded via the internet and is available in the market, it cannot be confined within the geographical boundaries and can be easily available to all influential persons having access to the internet. Hence, not conducting the exam all over India is in violation of the fundamental right of students,” the plea stated. “If the examinations are not conducted all over India, the future of so many candidates who did not take illegal means will be shattered as the persons who secured the leaked question paper through illegal means will secure better position in the merit list of IIT-JEE and good colleges. Conducting the examination afresh is in the interest of all…,” the plea stated. The court has asked the CBSE to conduct an inquiry and submit a report by March 28.
