The Department of Homeland Security has published a memo laying out the Deferred Action for Parents (DAP) program in a little more detail. DAP will apply to those individuals who: • have, on the date of this memorandum, a son or daughter who is a U.S. citizen or lawful permanent resident; • have continuously resided in the United States since before January 1, 201 O; • are physically present in the United States on the date of this memorandum, and at the time of making a request for consideration of deferred action with USCIS; • have no lawful status on the date of this memorandum; • are not an enforcement priority as reflected in the November 20, 2014 Policies for the Apprehension, Detention and Removal of Undocumented Immigrants Memorandum; and • present no other factors that, in the exercise of discretion, makes the grant of deferred action inappropriate.
