The Doctrine of Discovery (U.S. Supreme Court- Johnson v. - TopicsExpress

The Doctrine of Discovery (U.S. Supreme Court- Johnson v. McIntosh, 1823): upon discovery the European nation, or the nation that succeeds to its interest-- the U.S. from Great Britain-- holds superior title and sovereignty to the land belonging to the Indians... Quite the legal principle undergirding Western Civilization. Of course, it matters what definition of discovery is used. I can see how if the people living in the land are deemed savages and barbarians (i.e., uncivilized), when a civilized invader appears, discovery takes place so the invader becomes a discoverer. As the Celtic chieftain Brennus supposedly said to the Romans after the Battle of Allia (390 B.C.E.), Woe to the conquered!
