The Due Process clause of the Fifth Amendment was relied upon by the Supreme Court to overturn section 3 of the Defense of Marriage Act. In essence, they stated that law should apply to everyone equally and DOMA was exclusive. Turning now to the recent delay in the execution of Obamacare for large business but not for individuals. Does this not sound the same? One more thing. In American constitutional law, a statute is "void for vagueness" and unenforceable if it is too vague for the average citizen to understand. Can everyone understand what we are about to be saddled with? I dare say not.
