The General accounting office (Fed. Gov. Auditing arm) Has ruled regarding the liberation of 5 terrorists for bergdahl: Not only did the GAO (General Accounting Office) rule that it was illegal to make the trade but that Eric Holder’s DOD (Department of Defense) also broke the Antideficiency Law by using illegal funds that weren’t appropriated to pay the costs of the trade. The Antideficiency Law prevents government agencies to use money that was not appropriated for that use: “[The Department of Defense] violated section 8111 because it did not notify the relevant congressional committees at least 30 days in advance of the transfer. In addition, because DOD used appropriated funds to carry out the transfer when no money was available for that purpose, DOD violated the Antideficiency Act. The Antideficiency Act prohibits federal agencies from incurring obligations exceeding an amount available in an appropriation.” The GAO rejected the Obama administration’s contention that the trade was legal. They refused to consider Obama’s contention that the Antideficiency Law was unconstitutional, noting that only the Supreme Court has the ability to rule on a law’s constitutionality: “It is not our role or our practice to determine the constitutionality of duly enacted statutes. In our view, where legislation has been passed by Congress and signed by the President, thereby satisfying the bicameralism and presentment requirements in the Constitution, that legislation is entitled to a heavy presumption in favor of constitutionality.” The GAO was only confirming the illegal act that everyone in America already knew about and liberals refused to admit.
