The Gutter Fiqh Approach of Shaykh Mumtazul Haqq and Shaykh Abdul Raheem Limbada, and why Fiqh should never be sought in weaponised, polemicised or controversial form. What caught my eye is what the former said - as approved and shared by the latter - regarding a narration from Ibn `Umar throwing pebbles at those not doing Raf`ul Yadayn in Salah, which is reported in Imam al-Bukharis book, جزء رفع اليدين. Mumtazul Haqq says: ___ This narration of throwing pebbles is such a fabrication and simply baseless that no one else has even bothered to give it any importance at all except the modern Salafis. Many scholars wonder how could Imam Bukhari ever even consider putting this in his Juz Rafa Yadain , if that was written by him, as many even do not consider Juz Rafa Yadain to be writtwn by Imam Bukhari but by an anonymous person and wrongly assigned to Imam Bukhari. ___ Are Shaykh Mumtaz and Mufti Limbada seriously suggesting that the book جزء رفع اليدين is dubiously ascribed to Imam al-Bukhari by a lying anonymous person? Also, is Mumtaz a Muhaddith to be able to so casually make the judgement that Ibn `Umars narration is fabricated? I checked the Takhrij and it is in many many works, not just this book. Are Shaykh Mumtazs remarks true this Islamic Fiqh? Is this how Raf`ul Yadayn - also practised by Shafi`is and Hanbalis - should be refuted by a Hanafi? By ending up doubting the very ascription of a book that is well established from Imam al-Bukhari? This is not Islamic Fiqh. This is not even justice, fairness, or academic honesty. This sounds like a bunch of savages fighting it out to the death. But lets assume that Shaykh Mumtaz is truthful in his claim, the sad thing is these evidences - which laymen have no business in reading up on or studying - are being pumped out to the masses, by which they are being exhorted to make Tarjih between the claims of Raf`ul Yadayn and non-Raf`ul Yadayn. In the process, these so-called defenders of Hanafi opinions adopt a very *** (prejudiced) attitude themselves and for their cheerleaders, which they claim to refute and be free from. Make no mistake about it - these hardcore Hanafis are as dangerous as hardcore *** (taqleed rejectors). In fact, with this lowly attitude, inferiority complex, siege mentality and gutter Fiqh approach, they give more ammo to hardcore *** (taqleed rejectors) than they could ever possibly hope for, as even they would feel forced to defend the injustice perpetrated against Imam al-Bukhari by Shaykhayn Mumtaz and Limbada. For those who havent formally studied, please please steer clear of such polemics - for your own sanity. Otherwise, you will think your religious world is collapsing around you. You will become lost in the myriad of opinions, evidences, arguments, counter-arguments, refutations, counter-refutations. Amidst all the bickering, you might lose your bearings and your religious navigation. And if you blindly choose sides, you will be just a cheerleader.
