The Immigration and Nationality Act (INA) defines classes of deportable aliens. It doesnt mandate that anyone do anything with them. Specifically, 8 U.S.C. sec. 1227(a) leaves it up to the discretion of the A.G., stating Any alien (including an alien crewman) in and admitted to the United States shall, upon the order of the Attorney General, be removed if the alien is within one or more of the following classes of deportable aliens[,] going on to define the classes. How, then, does the executives decision--after all, deportation is an executive function up to the Department of Justice and the Department Homeland Security--to defer deportation run contrary to the statute, let alone to the Constitution? Can you point me to a particular Article or Amendment? Im no Obama cheerleader, but I like it when he does things that conservatives are too dumb to understand. He even gave the GOP the solution pass a bill.
