The Indian Union said Monday that the poll reforms fall in legislative domain. It also reminded the apex court that it was a stated position that court didn’t interfere in policy matters of the state unless the policy violated the mandate of the Constitution or any statutory provision or was otherwise actuated by mala fides. Is this true? If I have some understanding of law and also some understanding of how the Indian system works, then indeed yes. One cannot create India by listening to and reading foreign news or visiting foreign websites. First of all, in the West, the executive and legislative are very powerful but even if judiciary and regulatory bodies are also powerful there still Indians are not Westerners and by no stretch of imagination they can be like them in present in any foreseeable future. Sure, the whole is not necessarily sum of parts as it depends on the degree of non-linearity. But even if it is agreed that 10% of Indians, which is unimaginable at this moment of time, imitate Western culture even then they won’t be Westerners in attitude; they shall copy them in behavior, mostly for material and other tangible gains. Equality, symmetry and parity are dreams for a significant majority of Indians. Therefore, imposed morality is no substitute for reality. In this real India judiciary and regulatory bodies cannot be given the sole power to decide the future of almost 1.2 billion imperfect Indians. While Anglicization and Westernization is a must for a nation like India, at least middle class Indians should not become ‘wanders of imaginary land’. They should not have any aversion to filth, corruption, mismanagement, imperfection, inconsistency, inequality and injustice prevalent in India which is there since the time immemorial. Sure, India should move forward but that pace has to be decided by the demographic and social equations. Unnecessarily creating edge; those which add to problems and they are not their solution, are bad options. Let India evolves in the best possible way. Highly correlated in-phase co-evolution may not be possibility. Let activists and highly educated people understand their limits and let India evolves in its own unique way where there is a place for all possible people. Therefore, in this regard the judiciary and regulatory bodies can be termed as elitist and exclusive while legislature and executive are more inclusive and realist.
