The NDA Government lead by Sri Narendra Modi had created an unprecedented tradition by appointing a former Chief Justice of India Sri Sadashivan as the Governor of Kerala. Never in the past any Chief Justice of India had been provided a post retirement benefit like governorship. Practically speaking the post of Chief Justice of India is much more powerful than the post of a governor. So after serving as the Chief Justice one should not desire for any ornamental posting which the governor’s post is. No doubt Sri Sadashivan was preferred as a judge of outstanding integrity and honesty. But since the declaration of his appointment so many motives had been included by various parties on him. This is not adding to any clean tradition a democracy is supposed to develop. True, in the past former Chief Justice like Sri Ranganath Mishra had been appointed as the Chairman of the Linguistic Minority Commission. But that itself was a wrong precedent with ulterior motive. When he recommended reservation for dalit Christians and dalit Muslims. Of course no where in the constitution it is written that a Chief Justice of India will not be even any governmental position after retirement. But everything can not be written in the Constitution. All the country’s developed conventions besides the Constitution to run the country. Likewise conventions not given any post-retirement benefit to the Constitutional Bodies like CAG, UPSC Chairman, Election Commission’s members, Supreme Court’s judges should develop. The previous ruling Congress Party has created very wrong tradition like appointing the Chief Election Commission as the Rajya Sava member. BJP should not follow such wrong traditions. By appointing Sri Sadasivan as the Governor BJP is showing that it is in no way different from Congress.
