The Oregon marriage equality deal is done and final. Heres why: The state refused to defend the voter-passed ban. The state refused to appeal when the judge ruled the ban unconstitutional. The judge refused to let private, anti-marriage litigants into court and the 9th Circuit refused to intervene - and the U.S. Supreme Court already ruled that non-state litigants have no standing which is why the 9th Circuit Court of Appeal denied any stays - there was no one with legal standing to appeal. The state sat back and the deed is done and over. No Supreme Court involvement.
