The Penokee Pillage Did it begin in 2013? Technically yes, but GTac is only one in a long list of Conquistadors. It began in 1493 after Columbus had already invaded the Americas. We now call it the Discovery Doctrine but it might better be called the Destruction Doctrine. Pope Alexander VI needed a way to hide the land grab. Thus, he declared that any non-Christian land was unoccupied therefore suitable for the taking. This declaration completely disregarded the rights of Indigenous Peoples allowing the wanton stealing of land previously inhabited for thousands of years. It manifests in the trumped up behavior of the military-industrial-legislative complex to this day. The United States Supreme Court codified the Discovery Doctrine in its ruling on Johnson v. MIntosh in 1823. With Chief Justice Marshall writing, the Court held to the theory that Christian expansion and possession of newly discovered lands, despite native presence, was one by which all colonial powers operated. The esteemed principle of jurisprudence called Monkey See, Monkey Do. The United Nations Permanent Forum on Indigenous Issues has condemned the Discovery Doctrine as socially unjust, racist and in violation of basic and fundamental human rights. I am not a lawyer but, to my knowledge, J v. M still stands in the U.S. and at least one subsequent decision held that tribes are NOT independent states but domestic dependent nations. Parsing the legal nuances of treaties, etc. is not my game but it sure seems that racism has been codified in Western practice for a long time and is the nut the next seven generations will need to crack - hopefully sooner. No more extraction on or near Indigenous land!
