The President continues to innovate in the role as head of the Executive Branch of government. He sits on the Resolution desk in the Oval Office to make a one-minute video (an unusual informality in a symbolically very formal location associated with the most serious of addresses to the nation) as a promo for a speech that promises to go beyond the scope of prosecutorial discretion consistent with the intent of the law to law-making in a way that previously was left to the Congress. As an immigration lawyer, I agree the system is broken and needs fixing. For my clients, I welcome relief from any branch of the government. As a constitutionalist, I dread the ramifications of the Presidency seizing this authority from the Congress since the immigration law of the United States is one of the areas explicitly delegated to the federal Congress for development.
