The Rules of Court provides protection under Rule 134 on “Perpetuation of Testimony.” You can do this by filing a verified petition in the court. Among others, your petition should contain the facts which you desire to establish by your testimony and your reasons for desiring to perpetuate it. You also have to give the adverse parties. If the court is satisfied that the perpetuation of the testimony may prevent a failure of justice – meaning to say that you may no longer be alive to testify – the court will order a deposition to be taken.
