The Tax man is moving…..INFLEXABLITY and negotiations. Dealing with the ATO has never been easy, but over time we have learnt that patients and being sensible are the starting points. Below are three comments made by our accounting seniors about dealing with the ATO: Mr T • It really depends on who you deal with at the ATO; some are INFLEXABLE and play by the rules while others are more sympathetic. • If client has defaulted previous payment plans, usually the ATO is going to be more difficult and make it harder to come into new payments plan. • To reduce the payment plan, we have to work within the scope of the tenure that the ATO allows to pay off current tax debt, which is currently 2 years and also depends on some fact finding about clients’ business i.e. The ATO wants to know if a client can sustain the payment plan moving forward or has big upfront payment in the pipeline. However, we need to convince the ATO about the timing of the upfront payment • We have helped countless clients to sort out their taxes e.g. requesting for more time to pay, applying for hardship and remission of interest and penalties or stopping further recovery action by the ATO. Lady T • Can be difficult to change payment arrangement as they have already committed – like breaking a promise • With the ATO, it really depends on the topic as to how helpful or unhelpful they are • They can be helpful, but they are less flexible then they were before Rena • It can depend on the situation, if the client has been through a hard time it can be easy to get interest remitted and lower payment plan, if there is no reason – it can be very difficult • If clients can make a lump sum payment, that may be able to help • Hardship applications are a lot harder now, the ATO wanting more information and change of legislation
