U.S. Elonis, whose wife left him, posted a threatening Facebook passage about her, but claimed it was First-Amendment protected free speech, because the rant was comprised of rap lyrics, in the style of an Eminem rap. Elonis argues the Court should look at his intent behind the post, rather than whether a reasonable person would feel threatened by the post.
