The USPTO Board recently ruled that the Motion to Dismiss by DI will be considered by the Board after Denvers Petition to the Director is decided which could take from 2-6 months based on previous time it took.It also appears that Bertini is unduly delaying the case which has been suspended due to his filing of many irrelevant motions. It would have been better had Bertini gotten proper legal advice about the law and procedure which would have enabled the case to progress faster. The Board d also also reprimanded Denver for a second time, stating the following: Under the circumstances, Denver should have contacted the Board attorney assigned to this case to alert the attorney to the filing of the motion to dismiss.
