The ability to deny acknowledging how the world really works in this decision reminds me of their denial of reality in last years decision in Shelby County v. Holder which struck down the section of the Voting Rights Act that required certain states and counties with a history of voting discrimination, mostly in the South, to obtain ‘preclearance’ from the federal government before they could make any changes in their voting procedures. The heart of the conservatives argument was that racial discrimination simply isnt a factor anymore. Then they revived a long discarded principle of “equal state sovereignty.” Nowhere in the Constitution does that phrase, or any synonymous phrase, appear. It is a constitutional mandate of the Court’s own pure fabrication. The idea of “equal state sovereignty,” however, has impressive historical roots: it was a favorite rhetorical device of slave states before the Civil War. And if you remember, it took a single day after that decision for Texas to pass new voting laws that discriminated against black voters. Im sure it took even less time after this decision for the GOP money brokers to begin exploiting their new loophole in the campaign finance laws.
