The biggest problem for litigants is judges who knowingly allow lawyers (and litigant also) to misrepresent the facts, present forged documents and openly tell lies in court. Such judges, who don’t take action against those mislead the court, are the biggest enemies of justice, because they derail the course of the entire case, give an unfair advantage to crooks, and deprive honest litigants of justice. Usually, such damage is permanent, and appealing cannot undo it. Approaching higher courts is costly, time-consuming and often not feasible. For most people of India (and the lawyers representing them) who stay in the interiors, travelling to the state capital or national capital for hearings is not feasible. Appealing is an imperfect remedy in our judicial system.
