The constitution of the federal republic is not clear as to whether or not the seat of a defecting executive shall be declared vacant,it is not also in the jurisdiction of the party that sponsored them to ask for vacation. But the constitution is very clear on the legislature as spelt out in sec.68,sub 1 g, even if they go for apeal,the position of the law is that they will still vacate untill the determination of the case on apeal. What they should do is to sought for stay of execution before apealing. Be that as it may,the determination of the final judgement even at the supreme court will be the same. Let them go back to PDP or resign honorably,as the court adviced,and then seek for re-election from their party of interest. Only if they will win.lol.
