The difference between a plaintiff and a defendant is that the plaintiff is the person who is filing the suit, while the defendant is the person being sued. The plaintiff is simply is the person who makes the decision to bring a situation before a court of law. The plaintiff sits on the left side of the courtroom. The defendant sits on the right side of the courtroom. Another difference between the two, is that the plaintiff gets to present their case first if there is a trial.
