The final reading of an ordinance to modify procedures and regulations for nonconforming uses, lots and structures is Item 2F on the Jan. 5 Burleson City Council agenda, bit.ly/010515council. Burleson has a significant number of non-conforming uses, particularly in areas that have been recently annexed, but also in areas where older uses are present. The current ordinance needs improvements to dictate how staff works those cases, particularly in some situations those discussions result in legal disputes between the City and the owner of a non-conforming use. Modifications proposed by the City Attorney’s Office address the intent of the City to allow the continuance of legal non-conforming use but not encourage their survival.
