The meeting is tomorrow morning everyone! The City of Norfolk has made a request to have the NEW conditional use permit posted to this Facebook page. Notice I said NEW permit. They have relaxed a little on the time frame and have taken the 72 decibels off. It appears to me that the city is willing to work with us on this, so lets make sure we keep an open mind and work with the city as well. This is the new draft of the permit. This is what will be presented at the meeting tomorrow morning by the City of Norfolk. Lets pack the place tomorrow and show our support!! By the City of Norfolk, 309 N. 5th Street, Norfolk, NE 68701 CONDITIONAL USE PERMIT RESOLUTION NO. 2014PC-5 WHEREAS, Off Road Ranch, LLC filed an application for a Conditional Use Permit for a stock car race track on property which is legally described as follows: The N1/2 of the S1/2 of the NW1/4 and all that part of the N1/2 of the NW1/4 lying and being South of the County Road commonly known and referred to as “the Stanton Road” and as “Old Highway No. 8”, all in Section 6, Township 23 North, Range 1 East of the 6th P.M., in Stanton County, Nebraska WHEREAS, the property described above is presently included in Zoning District I-1; and WHEREAS, the Norfolk Planning Commission has conducted a public hearing September 3, 2014 receiving input and data from the applicant and the general public concerning the Conditional Use Permit; NOW THEREFORE, in consideration of the foregoing recitals, the Planning Commission of the City of Norfolk, Nebraska hereby adopts the following Resolution: BE IT RESOLVED by the Norfolk Planning Commission of the City of Norfolk, Nebraska that Off Road Ranch, LLC is hereby granted a Conditional Use Permit for a stock car race track on property subject to the following terms and conditions: 1. The stock car racetrack shall operate only on Saturdays, 6:00 p.m. until 10:30 p.m. from April 1 through September 15 only. Reasonable extension past 10:30 will not be in violation if caused by a race car accident(s); 2. That all litter within one hundred (100) feet of the Off Road Ranch property shall be picked up/cleaned up within 24 hours after each event or race; 3. Decibel levels at the property line of Off Road Ranch shall reach a maximum level of decibels (dBA). Applicant shall provide to the planning and zoning office an engineered noise study showing what measures will be necessary to meet this requirement. Applicant will install the recommended measures prior to the first race date. Applicant shall further have an engineer measure the actual noise levels at the property line during the first racing event, a copy of this study shall be provided to the planning and zoning office prior to the second race weekend. Additional studies may be required upon request; 4. Best Management Practices (BMP’s) shall be utilized as needed to provide for dust control and sediment track out generated by traffic leaving the site. To control track out, a minimum of 24’ x 150’ hard surfacing from the existing hard surfacing on Channel Road shall be installed at the point of ingress/egress to the property ; 5. Lighting to the racetrack shall be directed onto the track and not toward any area properties; 6. All access to the stock car racetrack shall be off of Channel Road; 7. A scaled, detailed site plan of the property shall accompany this permit. This plan shall include, but not be limited to, ingress/egress, locations of all structures, parking, racetracks, floodplain location and bleachers. The attached site plan is hereby approved by the Planning Commission and shall be complied with; 8. Pursuant to the Norfolk City Code, this permit is for ten (10 years) and is a personal privilege; 9. There shall be compliance with any other applicable City, County, State or Federal regulations that may apply; 10. The Conditional Use Permit granted herein shall be subject to the provisions of the Norfolk City Code that provide for an appeal to be taken within 15 days of the decision of the Planning Commission.
