The minister says that the intention of the person was not to cause chaos but to defend his religion. This statement seems to validate inflammatory statements made in defence of ones religion – a rather dangerous statement in a multi-religious society such as ours. Is not this the same justification of the Islamic State in Syria for its beheading actions? Significantly, her statement suggests that intention is a key element in establishing the offence. Such exercise of prosecutorial function has been categorised as “persecution” by a former A-G and “abuse through selective prosecution” by a former minister, who is presently a senior member of the National Unity Consultative Council tasked with formulating a law to replace the act. Take yet another recent loud public cry for vernacular schools to be abolished. The call has become more strident in repetition. To date, no action has been taken. Nor indeed threatened. The call, though couched as promoting national unity, in fact questions the existence of the right to sustain the use and study of the vernacular languages as guaranteed by Article 152 of the Federal Constitution.
