The morning sessions saw the start of the examination of Witness Stephen Heder by Khieu Samphan’s Counsel, Anta Guisse. Heder confirmed that there were some confusions pertaining the leadership of CPK in pre-1975 period. He also confirmed that Khieu Samphan’s titles in the FUNK and GRUNK were “bogus” and the real power was in the hands of Pol Pot, and on foreign affair matters, Ieng Sary. On the issue of central policies, Heder stated that the lower cadres were typically instructed to treat 17s and 18s (referring to April 1975 and 18 March 1970) people equally and in solidarity in accordance with the party’s principles of equality. Heder confirmed he heard often that local cadres hoarded food for their own use, while others wanting to please the party and to climb the hierarchy would send their food-rations to the center claiming it to be a food-surplus instead of feeding their own population. Heder confirmed that people were afraid of cadres, but that cadres "living like feudal lords" was an "usual account." Heder also explained his method in making “objective summary” of his interviews, namely taking simultaneous notes as he spoke to the source, excluding the questions he asked, and later transcribed these notes on his computer. OCP raised some objections on referencing documents in putting questions to Witness, may it be whether the document was in the Rule 80 List or the extent of details submitted on the documents quoted. The Trial Chamber thus far maintained flexible stance in this matter.
