The president as the head of the executive branch has the inherent power to direct federal agencies to execute, enforce and to promulgate rules under the authority of this specific agencys enabling statute, in this case it is the Immigration and Naturalization Act for #USCIS. So #Congress did act to enable this agency and gave the power to handle immigration and naturalization matters in 2003 because agencies have the required expertise and congress cant simply cover every possible scenario in the field and include them in one act. In this executive order the president is directing his agency to make certain rules to carry out its mission. It is legal, logical and very reasonable. The same thing with the war on ISIS, Obama simply used the law on the books that Bush used and congress passed in 2001 to help fight terrorism. The law still valid, #Obama made the argument that ISIS is an affiliate of Al Qaeda and therefore the law applies to ISIS and he can act under this law. The GOP is far from being creative or smart. They think they are in control and that they can block and stall everything. The Obama administration has been going around and using this tactic for a while now. They look into the laws on the books and qualify the situation they are dealing with under a certain law to get the legal cover of their actions, and that is what is turning the #GOP crazy and shocking them. They are there, they are in power they dont want to act, yet the administration is pretty much getting everything they need done under the tons of laws that are still on the books, brilliant.
