The so-called tort reform lobby wants you to believe they are interested in only ending frivolous lawsuits, not legitimate ones. In reality, most tort reform has no impact on truly frivolous lawsuits and only serves to limit, if not totally eliminate, the Constitutional rights of those who have been harmed by the wrongdoing of another. In the case of Methodist Healthcare v. Rankin, the Texas Supreme Court ruled that a woman who suffered from chronic illnesses due to a surgical sponge that had mistakenly been left in her abdomen could not sue the negligent doctor.
