The suit — filed in Brooklyn Federal Court on behalf of two Muslim men, two mosques and a charity — says they have been subjected to unwarranted scrutiny because of an alleged practice of religious profiling by the NYPD. But the city is strongly opposing a demand for documents relating to NYPD investigations and surveillance of non-plaintiff Muslims and Muslim organizations over the past nine years. Assistant Corporation Counsel Peter Farrell noted in court papers that the disclosure of “extremely sensitive and confidential investigations” to the plaintiffs would not only jeopardize ongoing and possible future investigations but endanger the safety of undercover officers and iThe affidavit lists terrorist plots smashed by law enforcement since 9/11, including a planned suicide attack in the subway system by three Queens men who had traveled overseas to receive terrorist training, and plots by several would-be terror goons who were raised on Long Island . Lawyers for the plaintiffs contend that they need the documents to show the NYPD has a discriminatory “policy and practice” of investigating Muslims based on their religion.
