The update from the preliminary hearing for Ulises, Alex, Chris and Benji is that after two full days of court the judge decided that there is enough evidence against the Foxy 6 to send us to trial. The evidence against the Foxy 6 is entirely police testimony, but the word of the police is considered enough to justify a felony trial. The charges of felony assault on an officer against the Foxy 6 were cut down to misdemeanor battery charges because there was no evidence to suggest that the police suffered serious injuries. But the felony resisting arrest charges remain. Trial will probably be in late October or early November. The judge seemed to agree in court that the action of the police in restricting the protest and keeping the demonstrators off of the public sidewalk (which led to all of the arrests), but did not agree that this made their conduct in arresting Ulises, Alex, Chris and Benji unlawful.
