The yesterday’s weighbridge saga evident between the two honorable M.P’s and the security officers manning the said station, clearly demonstrated the magnitude of impunity, inequality and lack of integrity as practiced by some of our elected leaders. Under article 73 (1) (ii) of our constitution, it is provided that a leader shall behave in a manner that demonstrate respect to the people and the rule of law. Article 75 of the same law further establishes that, a state officer shall behave whether in public and official life, in private life, or in association with other persons, in a manner that avoids any conflict between personal interest and public or official duty and that, any person who acts in a manner that contravenes the same rule may be dismissed or otherwise removed from office in accordance to the provisions of article 75 (2) (a) (b) of the same law. Now, the demand to release the M.P’s truck as was made by the two Hon. M.P’s was wrong and contravened the said provisions enshrined in article 75 of our constitution and thus dismissal, recall and removal from office are the only remedies upon establishing a prime-facie case by the prosecution during the trial of this matter. If the above is exercised then equality and freedom from discrimination as established under article 27 of our constitution is guaranteed. Again, respect to the rule of law and practice of constitutionalism will be evident to all and in accordance with the law. It is therefore important if our state officers abide with the provisions of article 77 of our constitution where restriction on activities of state officers are established that, a state officer shall not participate in any gainful employment as was demonstrated by the said two M.P’s who ware fighting for the relies of a truck that only gain them apart from their position of Members of Parliament. #just a legal opinion#
