There seems to be a lot of confusion as to who what and where - TopicsExpress

There seems to be a lot of confusion as to who what and where regarding Gus. Gus is an old case of ours that ended in April 2014. We are going to try and summarize a very long and detailed situation to a brief rundown. Gus was saved from death after a 14 + month battle. He had attacked a woman while boarding (the details that led up to it dont matter, bottom line, he attacked and was seized awaiting death) Guss owner and her attorney lost in court and lost the right to appeal. Gus was doomed. TLP was called in. TLP had been waiting for case like this. One where the courts denied the right to appeal. A year earlier 3 other dogs were killed because the courts didnt allow an appeal. We found out after they killed the dogs. (The Austin 3) We vowed to correct this. And waited. We took on Gus case with our local attorney Christiana Dyjkman. We did the case in 2 parts purposely. If we only won the first part and they they killed Gus, he would not have died in vain. We appealed THAT decision (that we do have a right to appeal- so basically we appealed that we had the right to appeal ) and the appellate court AGREED with TLP and ruled there IS a right to appeal. MAJOR WIN. This decision helps ALL dogs charged under this section in Texas by guaranteeing their right to a fair review of their cases. Tlp also won the right to a jury trial, totally unheard of in dog cases. This too will help dogs in the future in similar circumstances. AT he 11th hour an agreement that was made was between Gus owner and the state of Texas. No one else was a party to it. He was sent to CM because there wasnt any body he could go to with based on the aggression he showed and he is not other dog tolerant. This was THE only option for Gus. The owner worked out whatever arrangements she made with the facility. We are sad for Gus. We are sad for the people who were innocently hurt, but we are angry as hell that Gus was brought to someone who clearly could not It handle a dog like Gus or follow simple instructions. Someone who knew better. Human error has failed Gus. Again. He will not die in vain. Because of Gus, we were able to make it better for dogs who are in similar situations. Because we are not a party to this, we are finding out much like you all are! When we emailed and asked DPC, they told us what we we posted below and now they are out of the loop because they are not a party to it either. We know what you know. We just just have the background on it which we posted above. Hope this helps clarify.
