There was a prisoner that I knew that was serving a 30 year sentence in federal prison for selling crack cocaine. Because the United States Sentencing Commission had amended the crack cocaine guidelines, he began making plans for himself and his wife since he believed his sentence would be reduced to time served. It seemed like every day after the amendment had become retroactive, prisoners were being released from prison. Unfortunately, any amendment that is promulgated by the Sentencing Commission is discretionary on the courts. Therefore, the court determined the 30 year sentence was appropriate for this prisoner. Thus, he remains in federal prison today! Point made—even though the Sentencing Commission has made changes to the federal drug guidelines, which will become effective on November 1, 2014, the federal courts do not have to apply these changes to your loved ones that are incarcerated, if the Commission makes the changes retroactive!
