This editorial speaks to instances where the arrestee supposedly used force when being arrested. There are unfortunately times where police officers lose their cool and use force first. They are not allowed to do this. Police may only use force if force is used upon this. When I see someone charged with one or all of the charges of Disorderly Conduct, Resisting Arrest, and Obstructing Governmental Administration, and nothing else, it is a red flag that this is an arrest to cover up police misconduct. The police often do a poor job of sufficiently alleging these charges. I have had quite a few of these cases dismissed as facially insufficient on motions I have written.
