This is a common question that people have... I was involved in a car accident. I wasnt at fault. I filed a claim with the other drivers insurance company, and now the claims adjuster tells me Im going to make you a one-time offer. Isnt this supposed to be a negotiation? Why do I feel like Im being forced to take whatever the insurance company arbitrarily wants to give me? And, why is the offer so low? ---------- Consider the following... In an ideal world, the insurance claim process would be fair and impartial where the claims adjusters is not employed and influenced by their employer (the insurance company). In reality, this is not the case. The claims adjuster is employed by the very same company that you are trying to obtain compensation from. That company is also in the business of making money - not losing money. Their objective, therefore, is to pay you and everyone else nothing. Once you understand the reality of the situation, then it makes sense why the claims adjusters speak and behave in the way they do. *** Understand the reality but dont allow it to take control of you. *** Keep a level head. Evaluate the evidence in your case. Educate yourself on what damages your are entitled to. Research what it might cost you to seek compensation through the civil justice system (i.e. the court). Run the numbers and see what makes sense to you. Remember what your math teacher told you? Show me your work, not just the answer. If you do your homework properly, youll know what range your case should settle (even with the costs of suing in court). If the number that the claims adjuster offers you is within that range, then it might make sense to accept. On the other hand, if the number is below the range then you need to decide if it makes sense to spend the (1) time and (2) money to file a lawsuit in court. *** The single best piece of advice I can impart is this: At the very least, speak to a few local personal injury attorneys to educate yourself on California personal injury law and how it might apply to your situation. Many attorneys in the personal injury field offer free consultations. Take advantage of this service! Keep in mind that speaking to attorneys does NOT obligate you to retain them for legal representation, so there really is no downside to making those calls. Stay safe!
