The amended Act will allow police to obtain orders imposing a range of restrictions on any organisation or individual without needing to prove criminal activity beyond reasonable doubt. Instead, police would only have to convince a court that on the balance of probability — a much lower burden of proof — an organisation or individual was engaged in criminal activity. Another amendment will remove the requirement that offences that could trigger the making of a declaration order must involve substantial planning and organisation. Planned changes to the Confiscation Act will let the assets of Victorian crime bosses (or any individual deemed to MAYBE about to do something wrong) be seized even if police have insufficient evidence to lay criminal charges against them. The “in your face” disruption tactic used successfully against bikies and Middle Eastern gangs was being extended to include a similar zero tolerance stand against other gangs and individual criminals.
