This is, actually, the issue...not racism. No one is allowed to record a conversation without your knowledge & expect it to be legally admissible. Why is it fine simply because (deeply) unpleasant personal views are exposed in the conversation? Private words are private, no matter how unpopular the views are to other people (& who is to say what is unacceptable?) - this is the definition of the slippery slope of relative morality. I dont agree with Donald Sterling, but he wasnt speaking to me, or you, or anyone else in public. Stalin & Hitler would be high-fiving each other, not over his beliefs, but at the shrug weve all given to this disregard for the Fourth Amendment & personal freedom.
