COUNTY OF SAN BERNARDINO AND DYNAMIC DEVELOPMENT JTDBA is pleased to announce the ruling by His Honor Donald Alvarez of San Bernardino County Superior Court, Department S32 in the court matter of Joshua Tree Downtown Business Alliance vs. County of San Bernardino and Dynamic Development. The Court finding is as follows: THE COURT GRANTS THE PETITION FOR WRIT OF MANDATE TO OVERTURN THE APPROVAL OF THE SUBJECT REGARDING THE MITIGATED NEGATIVE DECLARATION AND THE CONDITIONAL USE PERMIT ON THE GROUNDS OF FAILURE TO PROPERLY ANALYZE THE PROJECTS IMPACTS ON THE ENVIRONMENT IN THE AREA OF ECONOMIC IMPACTS RESULTING IN URBAN DECAY. THE COUNTY IS REQUIRED TO UNDERTAKE AN EIR FOR THE PROPOSED PROJECT. JTDBA commends Judge Alvarez’ decision that requires the County to do an Environmental Impact Report for the approval/disapproval of the Dollar General project according to CEQA requirements.
