This is a full copy of her story: I believe my story will attract many people’s attention and hopefully help the progressive people of New York to have accountable medical care and a transparent judicial system that is just and that will serve the purpose of its existence. I am a physician whistleblower- plaintiff in this action, who objected to improper and dangerous medical care that I observed in the labor and delivery department of the New York Downtown Hospital in 2007-2008.Many young mothers and babies died or were injured severely due to negligent care such as conducting operations in the patient rooms instead of the OR and using old and nonfunctional instruments along with the hospital’s overall culture of negligence, lies and secrecy. After my multiple objections in seeking to stop this negligent treatment, I reported the matter to the Department of Health (DOH) on several occasions. On April 16, 2008, I finally received an email response from the DOH. That same day I was paged and called into the office of my boss, Allan Klapper, M.D., who threatened that I would never practice medicine in this country again. Two days later I was fired by the hospital without explanation. In 2012, I went to NBC news and broke the story of a 16-year-old teenager who was not pregnant but was given a Caesarian section by obviously negligent doctors. Despite corrective measures that the hospital promised to implement, patients continued to suffer and die. In August of 2012 NBC News broke another story that 14 patients had unexpectedly died and that there were 40,000 medical mistakes reported to the DOH and that the DOH was keeping quiet about these complaints and violations. In 2012 the hospital ended up with a deficiency of $40 million. By July 1, 2013, the hospital closed both residency training programs (OBGYN and Internal Medicine) as well as its financial district and was acquired by the New York Presbyterian Hospital. In 2013, the government granted $125 million for the hospital’s reconstruction. My demand of Judge Hagler’s recusal: I have gathered very disturbing information over the last several years in regard to the presiding judge (Hagler) on my case. Judge Hagler is greatly influenced by Sheldon Silver who has been on the advisory board of the New York Downtown Hospital for many years and has continued in that capacity on the advisory board of the Presbyterian Hospital. I became aware of a long-term friendship and political alliance between Judge Hagler and the advisory board’s Sheldon Silver who is also the Assembly Speaker of New York State. Advisory board Silver has received election contributions from the very same law firm Epstein Backer&Green, P.C.(EBG) that is representing the hospital-defendant in my case. Knowing all of this, I am not surprised that for the past two and a half years since Judge Hagler has been on my case that all my motions have been denied and all the defendants motions were wholehearted approved. Judge Hagler is known as the surrogate son of Sheldon Silver per reputable news agencies reports. This fact was never disputed by the judge. As soon as Judge Hagler took over 800 cases from Judge Goodman who retired (March 2012), my case was almost immediately heard on May 21, 2012. At every single hearing, Judge Hagler threatened me with sanctions even though I was the one who did the right thing and tried to protect patients and the hospital bosses were the ones who were guilty of negligence and malpractice. Hagler did not give me a chance to even obtain the supplemental discovery. He constantly interrupted my oral arguments and has treated me as a lesser person or as a person who is acting in bad faith. His bias was not based on something I did wrong or because the motions were incorrect. Judge Hagler’s biased behavior was due to his conflict of interests involving the Advisory Board’s Sheldon Silver who helped him attain a seat on the New York Supreme Court directly from the Housing Court. Judge Hagler did not disclose this relationship. There are numerous examples of the injustice I suffered in Judge Hagler’s court such as a revived confidentiality agreement that had been made invalid ab initio by the prior judge. His actions also improperly placed my complete file under seal. He has placed me on a Temporary Restraining Order for more than two and a half years. Moreover, Judge Hagler disposed my case on February 6, 2014, and reactivated it only after my intervention. Judge Hagler denied my supplemental discovery which was essential since the hospital closed their financial district and its residency programs. But at the same time per the opposing side’s demand, Hagler on three separate occasions ordered that the hospital could obtain my personnel file from the Tallahassee Memorial Hospital where I worked eight years ago without an issue. It was an unsuccessful fishing expedition on the part of my opponents to find something negative about me. Judge Hagler also ordered a third day of my deposition which is unheard of. I was grilled by the defendants counsels who tried to force me to admit to their false allegations. I had no choice but to file a motion and demand Judge Haglers recusal since he never disclosed this conflicted relationship. If Judge Hagler does not recuse himself he may stay as the trial judge. In that case, I will be crucified for doing the right thing. This is a true David v. Goliath story. Unfortunately as a whistleblower I do not have the legal right to have a jury trial and public efforts to reach the justice are highly appreciated!
