This is the state of our system of criminal jurisprudence. My morning was spent listening to the plight on an innocent falsely implicated in a murder case by police while the actual accused roams free and how amazingly casual and irresponsible judiciary can be in refusing to give him any relief. A group of hired criminals attempted to kill a businessman due to political/business rivalry. The gunshot ends up killing his daughter. His brother files the FIR naming all the accused. Police arrests some of the accused. One of them even has his statement recorded before the magistrate stating all about the conspiracy to kill and clearly naming who all were involved. Police then files chargesheet. Suddenly, instead of one of the accused named in the FIR, another person of the same name, but whose fathers name is different and whose address is different is sought to be arrested by police saying he was absconding. It is only then this innocent chap learns to his horror that he is now accused in a murder case. All of this was done cunningly even though the documents clearly show that they are not the same person. He moved Sessions Court seeking relief to no avail. He moved HC nearly a year ago seeking relief, and both the HC and the lawyers who represented him seems least bothered that the rights of an innocent are being violated. While the actual accused are continuing to live their lives because police has either failed to find them (in spite of one of them being a government employee) or has not even named them in the chargesheet, an innocent has to run from pillar to post with NBWs and P&A being issued against him. I have accepted the responsibility to appropriately intervene and free him of this peril. I also feel strongly that the Investigating Officer who has done this willfully should be royally screwed through appropriate judicial means.
