This lawyer is not entirely correct in this essay. First, the civil hearing would not be sufficient under the constitution as due process because in fact, Wisconsin statutes as they are written effectively prohibit a person accused of animal cruelty to petition the return of the animals, thereby negating any due process. Furthermore, Wisconsin requires a monetary bond for the alleged care of seized animals, a statute which was already deemed unconstitutional in Louisville Kennel Club vs. Metro Govt. because it essentially requires a person to pay a penalty without having been convicted of a crime. The WI statutes under 951 would not hold up under scrutiny in federal court and are by their nature, unconstitutional. thedogpress/Columns/defense-for-seizure-cases_Kessler138.asp
