Malawi Electoral Commission MEC says it will have no mandate to prevent or stop the declared presidential winner in the May 20 elections, from conducting his/her inauguration ceremony after the commission has made public the official results. MEC Chairperson Maxon Mbendere said this on Sunday, during a press conference on the commission’s preparedness for the Tuesday’s elections. Mbendela said in the invent that some quarters have challenged results of the elections, the commission will have no power to call off any swearing in process, saying as it stands in the Malawi constitution currently, the electoral body’s mandate on the election ends the moment officials results are out. There are higher speculations of rigging in the fourth coming elections, with opposition political parties condemning the ruling Peoples Party of planning to amass more votes by deceptive means, which the Malawi Electoral Commission is refuting. Mbendela however, indicated that the laws of Malawi provide for seven days, counting from the day official results are made public by the commission, for the results to be challenged. “After we have announced the results, our job ends there as an Electoral Commission…..this means that it is up to the government and the declared winner to choose the date for their inauguration” said Mbendela. He added that the issue of the results being challenged is handled by the country’s courts. Some quarters have called for judicial review and amendments of the electoral laws, in a bid to allow some time between the release of official presidential winner and the inauguration exercise, so as to pave way for other political parties and others, who would want to challenge the results. But according to MEC chairperson Maxon Mbendela, such constitution review of electoral laws will take place next year, ‘when Malawi will already have a new president.
