Tim Ellis, Tasmanian DPP loses death by negligent driving appeal11 MINUTES AGO Tasmanias top prosecutor Tim Ellis has been unsuccessful in his appeal against a guilty finding in a death by negligent driving case. In June, Ellis was found guilty of killing Launceston woman Natalia Pearn in a head-on collision last year. His lawyers had put forward more than 20 grounds of appeal, including that the magistrate hearing the case made errors. Ellis maintained he was not awake when he drove in the wrong lane of the Midland Highway near Oatlands, killing the 27-year-old. The states top prosecutor has had his guilty verdict upheld. DPP Tim Ellis appealed his conviction for killing Natalia Pearn by negligent driving. Victorian Supreme Court Justice David Harper was brought in to hear the appeal, and revealed his decision in Hobart today. Justice Harper said in his judgement the only conclusion open to him was that Ellis was conscious up to and including the impact. Ellis was found guilty in June of killing Miss Pearn in a head-on crash in a Midland Highway smash in March last year. He appealed the decision last month, and his lawyers put forward more than two dozen alleged errors, and maintained that Ellis was asleep at the wheel at the time of the crash. Justice Harper has ordered the case back to original Magistrate Chris Webster for sentencing on December 23
