Title IX was originally intended to provide men and women equal access to a variety of educational programs. The statutes focus has shifted, though, from equal opportunities to equal participation. Supporters of Title IX now focus specifically on female participation in athletics while ignoring other areas of study in which women are underrepresented. Why are athletics programs being forced to meet gender equality standards while other college programs like dance and medicine are not? The Department of Educations Office of Civil Rights (OCR) created a definition of gender equity. An athletics program is considered gender equitable when the ratio of male to female collegiate athletes reflects the gender makeup of the undergraduate student population. Currently, women comprise 54 percent of undergraduates. Therefore, based on OCRs interpretation of gender equity, female athletes, scholarships, and athletic budgets must also comprise 54 percent of the total.
