These articles have it right: Re Prop 89: Rina Palta - S. CA Radio Judge Karlton ruled that while governors do have the ability to review the parole boards application of the criteria, they cannot deny parole based on factors outside the rules. And specifically, they cant effectively extend prison time retroactively. So in the case of inmates sentenced before 1988, when the law passed, the governor cant overturn a parole boards decision. SF Gate: he judge also limited the governors authority to overrule the parole boards decisions to find life-term inmates eligible for release. Karlton said the Constitution prohibits such actions against prisoners who committed their crimes before November 1988, when the voters empowered the governor to veto paroles.
