To, Hon’ble His Majesty, President of India . By Reg. Post/7.8.13 Hon’ble Chief Justice of India. Subj: Necessity to fix up duty of the Chief Justice of India to ensure that no injustice is allowed to prevail under any circumstances. Respected Sir, With due respect I draw your honour’s kind attention to the following alarming state of the affairs: 1. That, the State’s one of the basic implied duty is to ensure justice to all. Article 21 ensures Protection of Life & Liberty. Art.14 ensures equality before law. As such, our Constitution impliedly guarantees justice to all. But the Supreme Court which stands to ensure justice to all , practically protects the rich & wealthy people against the injustices of the lower Courts- having its binding technicalities to appeal & huge expenditure involved. As such, we the common mass who cannot afford to appeal through advocates and to bear the huge expenditure in running to the far away place at Delhi & to comply the technicalities, have been helplessly suffering injustices in the hands of the incompetent or corrupted judges of the Trial Courts & High Court .In rare cases, the state has been preferring appeal before the High Court and the victims of injustice preferring Criminal Revision but apparently, in many cases the judges of the High Court who are either incompetent or corrupted not only murdering the justice done by the learned judges of the Trial Courts deciding Criminal Appeals of the convicted but also openly & carelessly murdering the little justice done by the learned judge of the Trial Court deciding the Criminal Revision of the victims of injustice as in Kalyani murder case, the heavily bribed judges are I. Mohanty & H.S.Valla I have strongly commented many such cases in my books – Crimes of Orissa High Court Judges in Acquitting Criminals and Misusing S-304, IPC . But the state in most cases never cares to go in appeal before the Supreme Court against such huge injustices , And the Chief Justices of the Supreme Court like S. H. Kapadia & Altamas Kabir did not bother for such damn failures of the administration of justice – mocking at the Constitutional guarantees as in Arts. 14 & 21 and as such, the bride murderers are escaping justice by heavily bribing the corrupted judges of the High Court as in Kalyani murder case and the victims are suffering helplessly blaming their fate & being the citizens of such a Nation! 2. That, Art. 227 imposes superintendence responsibility on the Chief Justice of the High Courts on the performances of the judges of the lower Courts. But alas, the Chief Justice of the Supreme Court has no such Constitutional responsibility which allows such prevalence of jungleraj in the judiciary encouraging incompetent and corrupted judges of the High Courts to carelessly murder even the little justice done by the learned judges of the Trial Courts . And, even though such most condemnable heinous crimes are brought to the notices the Chief Justices of the Supreme Court (S.H.Kapadia & Altamas Kasbir ), they are turning deaf ears- encouraging corrupted judges of the Orissa High Court to openly & carelessly murder justice, allowing the murderers of the bride to escape justice!! 3. To materialise the explicit & implicit declarations of the Constitution, let Parliament to ensure justice to all, act as per Art. 138 (2) and Art. 140 etc to fix up the basic duty of the Chief Justice of India, not to allow any injustice to prevail under any circumstances. And, for this, for the common mass who cannot afford to appeal through advocates, or as per the technicalities, a simple appeal petition devoid of all technicalities needs be considered, a Bench of the Supreme Court needs be established in each state capital at least for the limited purpose to entertain such appeal petitions for onward despatch to the Supreme Court for final decision. 4. That, my bitter experience as has been indicated in my Speed Post Petition dated 22.07.2013 to Honourable P.Sathasivam, the Chief Justice of India is attached hearwith .My SLP through E filing vide Reference No 23138 & Diary No 5627 of 2012 against the decision of the above corrupted judges have been suppressed on a condemnable plea of unspecified removal of defects encouraging the corrupted judges to openly & carelessly murder justice to acquit the murderers of my daughter, Kalyani . A kind response is expected .
