To Hon’ble State Information Commission Haryana S.C.O. 70-71, Sector-8 C, Chandigarh Subject: - Request to decide my Case No. 5511/2013, Suresh Kumar V/s SPIO of DSE Haryana Sir, I have the honour to submit few lines for your kind consideration and appropriate action. 1. That I filed Second Appeal on 09-11-2013 for my RTI Application dated 17-7-2013 and Hon’ble SIC issued the Notice to respondents vide Case No. 5511 of 2013 and directed the respondents to furnish the written comments by 27-12-2013 but respondent neither supply the requisite information nor furnish the written comments and I sent the Rejoinder on 01-1-2014 (Annexure P-1 & P-2). 2. That Hon’ble SIC fix the next date for hearing on 17-2-2014 at 11:30 AM (Annexure P-3) and I sent the Supplementary Rejoinder on 10-2-2014 (Annexure P-4) which was delivered at SIC on 11-2-2014 (Annexure P-5). 3. That DSE Haryana supplied the information for Point No. 1, 2, 3 & 5 vide Letter No. 22/31-2014 (1) dated 13-2-2014 (Annexure P-6) which is misleading and for Point No. 4 & 6 neither supplied the requisite information nor replied till. Details of misleading for Point No. 1, 2, 3 & 5 is as below:- (1) Supply the CD containing the Data of 16384 Candidates, which may be Merit List of Advertisement No. 1/2005. (2) Did not supply the covering Letter by which DSE Haryana received this CD from CIIPP Punjab University Chandigarh. (3) SPIO provide the misleading information because after paying the Rs. 33 Lac to the CIIPP Punjab University Chandigarh, Amount Rs. 10156307/- was available in the Account No. 10444985227 of SBI, Chandigarh which is Public Money as it was received in the Form of Fee from the Candidates vide Advertisement No. No. 1/2005 which prima-facie shows that this Amount has embezzled by the DSE Haryana. (4) Neither supplied the information nor replied till date. (5) Information is incomplete as SPIO did not supply the information for second part of Point No. 5 (I) i.e. copies of receipt register of that Page on Leave Application of Sh. Balbir Singh received and Point No. 5 (II) i.e. copies of attendance register of Sh. Balbir Singh of that Page on which his Leave is mention during the period 01-11-2010 to 30-6-2013. (6) Neither supplied the information nor replied till date Further I state that I present in person on 24-12-2012 and 03-5-2013 in Case No. 2403/2012, Suresh Kumar V/s DSE, before the Hon’ble SIC but all in vain. This situation compelled me to file the Case in the Hon’ble Punjab & Haryana High Court Chandigarh. It is for your information & necessary action. yours faithfully (Suresh Kumar) H.
